Article 1: General provisions
Studio Cantillon's electronic web shop allows its customers to buy online.
These Terms and Conditions ("Terms") apply to all items in the online range and to each online purchase made by the customer from Studio Cantillon. Therefore, for each order placed through our online shop, the customer confirms that he/she has read, approved and accepted the Terms and Conditions.
The customer accepts that these Conditions are the only ones that apply, to the exclusion of his own general or specific (purchase) conditions, even if these stipulate that they are the only ones that apply.
Article 2: Prices
All prices quoted are always inclusive of VAT and all other compulsory taxes to be borne by the customer. If transport, reservation or administrative costs are charged, these are mentioned separately. The transport costs depend on the article and are mentioned at the time of purchase.
The price indication refers exclusively to the articles as worded. The photos serve as a background and may include parts of the articles that are not included in the price.
Article 3: Offer
All offers are only valid for customers domiciled in Europe. The articles are intended for normal domestic use only.
Despite the fact that the catalogue and the website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. If you have more specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we ask you to contact our customer service department in advance (see article 12).
With respect to the accuracy, currency or completeness of the information provided, Studio Cantillon is bound only by a best effort obligation. Under no circumstances shall Studio Cantillon be held responsible for material, typographical or printing errors.
The offer is valid as long as stock lasts and can be modified or withdrawn at any time by Studio Cantillon. Studio Cantillon cannot be held responsible if a product is not in stock.
Studio Cantillon is entitled to refuse orders or split deliveries without explanation.
Article 4: Online shopping
The customer has the possibility to buy the articles of the range online.
The purchase is completed when the customer receives a confirmation email from Studio Cantillon. The items are delivered to the customer's home at the delivery address indicated in the confirmation email.
Private customers will make their payments via the secure Worldline module. The professional customer (reseller) will make his payments by bank transfer.
Article 5: Delivery
The products will be sent to the delivery address given at the time of the order (home or other address). Studio Cantillon undertakes to make every effort to deliver the products as quickly as possible. The delivery times indicated in the webshop are given as an indication only.
If the ordered goods have not been delivered within 30 days, the customer and Studio Cantillon may agree on an additional period. If no extension is agreed, the contract shall be dissolved by operation of law and Studio Cantillon shall refund any payment received within 30 days.
Any damage and/or visible quality defect of the article or any other defect must be reported to our customer service immediately by the customer upon delivery.
The customer is offered different delivery methods beforehand.
Article 6: Reservation of ownership
The delivered items remain the exclusive property of Studio Cantillon until full payment is received from the customer. However, the risk of loss or damage shall pass to the customer upon delivery. If necessary, the customer undertakes to inform third parties of Studio Cantillon's reservation of ownership, for example in the event that any person should appropriate items not yet fully paid for.
Article 7: Penalties for non-payment
Notwithstanding the exercise of other rights available to Studio Cantillon, in the event of non-payment or late payment, the customer shall be liable, ipso jure and without summons, to pay interest of 10% per annum on the amount not paid from the date of non-performance. In addition, the customer shall be liable to pay a fixed compensation of 10% of the amount concerned, with a minimum of 25 euros per invoice, ipso jure and without notice. Notwithstanding the above, Studio Cantillon reserves the right to take back items that have not been (fully) paid for.
If the customer is still entitled to a refund from Studio Cantillon, the same penalties shall apply.
Article 8: Guarantee
a. Legal guarantee (for consumers only) :
According to the law of 21 September 2004 on consumer protection in the sale of consumer goods, the consumer has legal rights. Every article is subject to the legal guarantee from the date of delivery to the first owner. Any commercial guarantee leaves these rights intact.
b. General :
In order to make a warranty claim, the customer must be able to show proof of purchase. For items purchased online and delivered to the customer's home, the customer must first contact Studio Cantillon's customer service department; the customer must then return the item to Studio Cantillon at their own expense.
Any defects must be reported within 14 days of delivery. After this period, any right to repair or replacement will lapse.
The (commercial and/or legal) guarantee never applies to defects that are the result of accidents, negligence, falls, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions or directions for use, adaptations or modifications to the article, rough use, poor maintenance, abnormal or incorrect use.
The guarantee is not transferable.
Article 9: Waiver period
The provisions of this article apply only to customers who purchase items online as a consumer. The consumer has the right to notify Studio Cantillon that he/she renounces the purchase, without payment of a fine and without giving any reason, within 14 days from the day following the receipt of the product.
Customers who wish to exercise their right to cancel must contact Studio Cantillon
's customer service department within 14 days of receipt. Please complete the online return form on our website.
The customer shall return the goods to Studio Cantillon without delay and in any case within 14 days after having communicated to Studio Cantillon his decision to withdraw from the contract. The deadline is met if the customer returns the goods before the 14 day period has expired. The direct costs of returning the goods shall be borne by the customer. Only items in their original packaging or satisfactory undamaged packaging and accompanied by all accessories, instructions for use and the invoice or proof of purchase may be returned.
They will not be taken back under any circumstances:
• used, soiled, damaged or incomplete items
• articles made to measure for the customer
• items that can deteriorate quickly, perishable goods
If the value of the returned product has decreased in any way, Studio Cantillon reserves the right to hold the customer responsible and to claim compensation in the event that the devaluation of the good is the consequence of the customer using the good beyond the use necessary to verify the nature, characteristics and functioning of the good.
If the customer decides to withdraw from the contract, Studio Cantillon will refund to the customer all payments received from the customer to date, including the cost of standard delivery, within a maximum of 14 calendar days from the day Studio Cantillon is informed by the customer of their decision to withdraw from the contract. In the case of a purchase contract, Studio Cantillon shall have the right to wait to make the refund until all goods have been returned or until the customer has provided proof that all goods have been returned, whichever occurs first.
Any additional costs incurred as a result of the customer choosing a delivery method other than the standard economic delivery offered by Studio Cantillon shall not give rise to a refund.
Studio Cantillon will refund the customer via the same method of payment that the customer used for the original transaction, unless the customer has expressly agreed to another method of refund (e.g. voucher); in all cases, the customer shall not be charged for such refund.
Article 10: Privacy
Studio Cantillon undertakes to use your data exclusively for the execution of the agreed contract that you conclude through your order and to send you information from Studio Cantillon without obligation.
We treat your information as confidential and it will never be passed on, rented or sold to third parties. You may at any time request, correct, modify or delete your data that we keep in Studio Cantillon's customer list and you may refuse to allow Studio Cantillon to use your data for the purpose of sending you information. Simply send a written request to our customer service department.
The customer is himself responsible for the confidentiality of his login data and the use of his password.
Studio Cantillon strictly complies with the Belgian law of 8 December 1992 on the protection of privacy with regard to the processing of personal data. Via your user profile, you have access to all the data available about you for consultation, modification or deletion.
Studio Cantillon uses cookies. Cookies are a standard Internet technology that stores certain information and makes it available on the user's system. Cookies cannot be used to identify individuals, a cookie can only identify a machine. By using our online shop you agree to the use of cookies. Any user can set their computer not to accept cookies. If your computer does not accept cookies, you may experience problems during the ordering process. If this is the case, please contact us so that we can still process your order.
Studio Cantillon keeps (anonymous) visitor statistics online so that we can examine which pages of the website are visited and to what extent. If you have any questions about this privacy provision, you can contact our customer service department.
Article 11: Infringement of validity - non-waiver
If any provision of these Terms is found to be invalid, illegal or void, this shall not affect the validity, legality and enforceability of the remaining provisions.
The failure at any time by Studio Cantillon to comply with any of the rights enumerated in these Terms, or to exercise any right therein, shall not be deemed a waiver of such provision and shall not affect the validity of such rights.
Article 12: Customer service

Article 13: Modification of the conditions
These Terms are supplemented by other terms and conditions to which reference is explicitly made, and by Studio Cantillon's general terms and conditions of sale. In case of contradiction, the present Conditions shall prevail.
Studio Cantillon may change these Terms at any time without notice. Any purchase after the modification implies an acceptance of these new Conditions by the customer. The conditions that were applicable at the time of the sale shall remain applicable for the current contracts.
Article 14: Evidence
The customer agrees that electronic communications and back-ups may be used as evidence.
Article 15: Applicable law - Jurisdiction
Belgian law applies, with the exception of the provisions of international private law on applicable law and the Rome I Regulation on international sales contracts relating to movable property.
Any dispute shall be exclusively subject to the jurisdiction of the Courts of the district in which our registered office is located, unless we, acting as plaintiff, prefer to bring the action before any other competent Court. This shall also apply in the event of an incidental claim or guarantee or in the event of multiple defendants.
